J.S. Held Acquires Clark Seif Clark, Strengthening West Coast Capabilities for Environmental Claims, Disputes, and Catastrophe Response
Read MoreThis matter involves alleged violations of California wage-and-hour laws affecting non-exempt employees, asserted on a putative class and PAGA basis. Allegations encompass missed, short, or late meal and rest periods (and related premium pay), unpaid straight time and overtime, improper rounding practices, miscalculation of the regular rate of pay, unreimbursed employee business expenses, and derivative penalties for waiting time and wage statements, as well as penalties tied to Wage Orders and specified Labor Code sections and the timely provision/inspection of records. The complaint also asserts claims under the Unfair Competition Law. To frame the scope and potential exposure, we obtained and reviewed timekeeping data, payroll data, and roster information to compile a defensible class list and review period, ensuring the underlying data was clean, reconciled, and suitable for testing and quantification.
J.S. Held was retained to review and reconcile timekeeping, payroll, and roster data; construct a comprehensive class list and review period; and conduct a wage-and-hour compliance and exposure analysis. Specifically, we evaluated meal and rest period compliance and related premium pay, tested for unpaid wages and unpaid overtime, assessed rounding practices, recalculated the regular rate of pay (including applicable bonuses/incentives), and reviewed reimbursement of employee business expenses. We quantified potential waiting-time and wage-statement penalties, penalties for Wage Order/Labor Code violations, and issues related to timely records and inspection. We also assessed exposure under the Unfair Competition Law and PAGA. Our work produced a clean, auditable dataset, exception flags, and exposure ranges with scenario/sensitivity modeling for settlement evaluation, and, as needed, expert support and trial readiness.
