The Situation

J.S. Held consultants were retained to provide expert analysis in a legal dispute involving alleged construction deficiencies in a home built and sold by our client. The Plaintiff’s claims included water intrusion due to landscaping, improper floor framing, electrical inspection issues, and other construction-related concerns.

How We Advised

J.S. Held conducted a thorough review of the documentation provided by both the Plaintiff and the Defendant to assess the validity and cost of the alleged deficiencies. Our analysis included targeted repairs to address floor framing issues related to joist spacing and recommended repairs to the exterior deck rather than a full replacement. Regarding the electrical concerns raised by the Plaintiff, we reviewed the ESA inspection report provided by the licensed electrician, which confirmed that the electrical work was completed in compliance with applicable standards. As such, the Plaintiff’s request to remove the drywall for further inspection was deemed unnecessary. Claims related to landscaping and drainage were excluded from our recommendations, as the Plaintiff had significantly altered the original site conditions by constructing an additional structure near the home, which impacted drainage patterns. While the Plaintiff sought approximately $350,000 in damages, our expert assessment concluded that the necessary repairs would reasonably cost $25,000.
