An analysis of the EDR data from the passenger vehicle revealed that its driver was speeding and still applying the accelerator at impact. The key focus of the civil litigation was whether the conduct of the driver of the passenger vehicle was appropriate and whether the crash was avoidable.
J.S. Held personnel performed a site inspection, took high-definition 3D scans of the intersection, created a map of the site with drone photographs, and analyzed the site evidence using camera matching photogrammetry. In addition to evaluating the site evidence, our team analyzed the 3D impact configuration of the vehicles, the EDR data from both vehicles, the telematics data from each vehicle, and the cell phone activity for each driver. Finally, in conjunction with a human factors expert, we conducted an onsite visibility study and created a visualization that allowed the team to determine that the crash was avoidable. This allowed the defense to reach an early settlement and avoid trial.
